According to a report by the Brazilian website Universo Online, Otávio "Tavo" Gabriel and William "hFn" Medeiros are suing their former esports organization, paiN Gaming. The Dota players accused the organization of delaying prize payouts and labor law violations.
They filed the lawsuit in December 2018, with both players leaving the organization in January 2019. However, hFn later returned to the team in June 2019 and remained there until the Dota 2 roster was disbanded in April 2020. Additionally, Danylo "Kingrd" Nascimento also allegedly sued the organization around the same time. Kingrd dropped his lawsuit in November 2019 after settling out of court and then rejoined the roster.
The plaintiffs claimed that the organization intentionally delayed the payment of prize money owed for The International 8 and one other championship, for months. For this reason, they terminated their contracts, left the team, and were promptly signed up by Digital Chaos (now Chaos Esports Club). The lawsuit also claimed that their contracts with paiN Gaming violated Brazilian labor laws by signing the players for more than two years.
The court confirmed that their contracts were indeed in violation of labor laws. Based on the evidence provided, the Judge also concluded that the organization had withheld its player's prize money beyond the term stipulated in their contracts.
The lawsuit is currently still in progress, with paiN Gaming awaiting the final verdict before it proceeds to appeal at a higher court.
