3D Realms, the creators behind the Duke Nukem franchise are being sued for their first-person shooter game, Ion Maiden. According to The Daily Beast, British heavy metal band Iron Maiden, filed the lawsuit on May 28. It accuses 3D Realms of “the misappropriation and use of virtually identical imitation of the Iron Maiden trademark”.
Besides the nearly identical name, the lawsuit also states that the steel cut logos are similar in appearance which could lead to “confusion among consumers”. It brought up another similarity between the heroine’s name, Shelly Harrison with that of the band’s founder, Steve Harris.
There are images and a character Iron Maiden associates with their brand that was supposedly used in Ion Maiden’s merchandise too. Quotes from consumers who mistook the game and its merchandise for official Iron Maiden products were also included since the band has released games of its own in the past.
In reparations, Iron Maiden Holdings (the band’s holding company) is asking for $2 million in damages and would also like to have Ion Maiden’s website either given to them or taken down.
